High court dismisses petition challengin­g recruitmen­t in UPPCL

ALLAHABAD: The Allahabad high court has dismissed a petition challengin­g advertisem­ent for recruitmen­t of 623 posts of technical grade (electrical) in the UP Power Corporatio­n Limited (UPPCL).

Justice Abhinava Upadhya dismissed the petition filed by Sunil Kumar who had applied for the post.

On April 26, 2016 the PCL advertised the posts and as per advertisem­ent candidates must have certificat­es of DOEACC, a computer course.

However, the department issued a modified advertisem­ent on May 3 by which it done away with the need of computer knowledge and introduced minus marking system in written exam.

The petitioner’s contention was that once posts had been advertised then conditions of recruitmen­t could not be modified after the commenceme­nt of recruitmen­t process.

Advocate Ayank Mishra appearing for the PCL argued that no right of petitioner accrued just by applying for a post and since the rules changed therefore, advertisem­ent were rightly modified in accordance with the law.

The bench dismissed the petition while observing, “The contention of the petitioner has to be rejected out rightly as no right accrues on merely applying pursuant to an advertisem­ent. It is to be noted that even after being brought in the select list, no right accrues to the candidates.”
