IAS Assn wants early amendment to PC Act

LUCKNOW: Uttar Pradesh IAS Associatio­n wants early amendment to section 13 (1) (D) of Prevention of Corruption Act (PCA) to protect honest officers. It also wants a provision for making prior permission of state government mandatory for prosecutio­n of retired officers for irregulari­ties during their tenure.

A demand for an early amendment to the PCA was made at associatio­n’s annual general meeting (AGM) at the Civil Service Institute here on Friday.

The associatio­n will request the Indian Civil and Administra­tive Service (Central) Associatio­n to take up the issue with the union government to expedite the issue that has been pending in Parliament.

“We will request the central associatio­n to take it up with the Union government and expedite the matter,” said Uttar Pradesh IAS Associatio­n secretary Alok Kumar.

An amendment to the act has been a point of concern among the IAS officers as there were cases recently when officers having a clean record have been charged with corruption for ‘honest mistakes’.

A senior officer said in a welfare state any decision taken by an officer may benefit one or the other individual or entities and defining public interest may be difficult in many cases. “The PCA, therefore, should clearly provide for protection of officers if a decision had not been taken for benefit of self or to serve own interest,” said the officer.

The associatio­n also wants that there should be a provision for prior sanction of state government for prosecutio­n of retired officers for the work they may do while holding office. “The PCA provides for prior sanction of state government for prosecutio­n of serving officers and same protection should be given to retired officers for decisions taken by them while in service,” he said.

Central associatio­n secretary Sanjay Bhoosreddy, who was

present at the AGM, said the central body had already taken up the issue and the amendment to the PCA had been pending in parliament since 2015.
