LUCKNOW : The tussle between IPS and IAS officers over posting of station house officers (SHOs) intensified on Friday with district magistrate of Gautam Buddha Nagar (Noida) Brajesh Narayan Singh cancelling the posting by SSP Ajay Pal of seven police inspectors at different police stations.

In a letter to the SSP, the district magistrate said: “The state government issued an order on May 9 stating that the superintendents of police

will have to take the approval of district magistrates for posting and transfer of SHOs. But without taking approval of the DM, seven inspectors were posted at police stations in the district. This was clear violation of the state government order.”

The DM further said that though the SSP is head of the district police force yet, according to the state government order, he will have to take approval of the DM for the transfer and posting of SHOs. “Since the SSP has overlooked the order, he was left with no option but to cancel the transfer order issued by SSP,” he said.

Meanwhile, the UP IPS Association has urged the DGP to take up the issue with the state government. President of the IPS Association Parveen Singh said since the matter is administrative, the association has urged the DGP to raise the issue with the government.

A senior police officer said the DGP has sought view of the police personnel department and legal cell over the issue. The Supreme Court, in an order a few years back, has stated that all transfers of police officers will be done by the Police Establishment Board, but the board has been made ineffective.

The Allahabad high court, in a recent order, has authorised the SPs to make transfer and posting of SHOs.

The state police will draw the attention of the state government toward both the orders, the officer said.

On Wednesday, principal secretary (Home) Arvind Kumar issued the order that said superintendents of police of all districts will have to take clearance from the district magistrate regarding posting of SHOs.

Reacting to the order, the All India IPS Association on Thursday urged chief minister Yogi Adityanath to withdraw it. “The order is in conflict with the law laid down by the Supreme Court and the high court. It displays distrust in the police leadership and demoralises the SPs as well,” an office bearer of the IPS Association said.
