GORAKHPUR/ALLAHABAD: A 67-year-old social worker Pervez Parvaz, who had filed a petition before the Allahabad high court and the Supreme Court in connection with the 2007 Gorakhpur riots case, in which the then Gorakhpur MP Yogi Adiyanath is the prime accused, was arrested in an over threemonth-old gang-rape case late on Tuesday night from a house in Turkmanpur in Gorakhpur, police said. He was sent to jail on Wednesday. However, the Allahabad high court has stayed the arrest of the co-accused Mahmood alias Jumman Baba in the gang-rape case.

GORAKHPUR/ALLAHABAD: A 67-yearold social worker Pervez Parvaz, who had filed a petition before the Allahabad high court and the Supreme Court in connection with the 2007 Gorakhpur riots case, in which the then Gorakhpur MP Yogi Adiyanath is the prime accused, was arrested in an over three-month-old gangrape case late on Tuesday night from a house in Turkmanpur in Gorakhpur, police said. He was sent to jail on Wednesday.

However, the Allahabad high court has stayed the arrest of the co-accused Mahmood alias Jumman Baba in the gang-rape case.

A bench comprising justice Ramesh Sinha and justice DK Singh passed the order while hearing a petition filed by Jumman and Parvez Parvaz, the social worker who has been arrested.

The petition with respect to Parvaz was dismissed as it became infructuou­s because he was already arrested by the police.

Earlier, on Tuesday night, a police team led by Rajghat station house officer Anil Upadhyay and Mahila Thana station house officer Shalini Singh raided the house and arrested Pervez Parvaz, a police officer said. Parvez, along with his friend Asad Hayat, had filed a complaint against Adityanath at the Cantonment police station in Gorakhpur in 2007, accusing him of inciting the riots thorough a hate speech at the Gorakhpur railway station on January 27, 2007 .

Superinten­dent of police, Gorakhpur City, Vinay Singh told reporters, “The accused has been arrested on the complaint of a local woman who had lodged the gang-rape case at the Rajghat police station. A hunt is on for the other accused in the case.”

The case against Parvez, and his friend Jumman, a faith healer, was lodged under Section 376D (where a woman is raped by one or more persons) of the Indian Penal Code at Rajghat police station on June 4 this year on the complaint of the local woman, who accused the duo of raping her at the house of Jumman, the officer said.

During the initial investigat­ion, the charge was found to be false and the police sent a final report to the court giving the accused a clean chit, people familiar with the matter said.

Later, Gorakhpur SSP Shalabh Mathur ordered fresh investigat­ion of the case on August 18, while quoting a report of a police officer, Shalini Singh who had submitted that final report in favour of accused was wrongly filed by the earlier investigat­ing officer while ignoring credible evidence.
