LUCKNOW: The Lucknow Development Authority (LDA) is compiling details of properties of two developers who have projects in Lucknow and have violated norms of Uttar Pradesh Real Estate Regulatory Authority (RERA) or have not been able to fulfill commitment made to homebuyers.

To note, the UP RERA has sought details of properties of 10 developers against whom it has received complaints from home buyers. Two of these developers have projects in Lucknow. Most of the developers have projects in National Capital Region (NCR).

According to UP RERA officials, despite several reminders and notices, these developers have neither handed over possession of flats nor refunded money to homebuyers.

The UP RERA might go for auctioning of properties of these developers, say officials.

“We are compiling details of properties of two developers who have projects in Lucknow. The UP RERA has sought these details,” said Shivakant Dwivedi, vice chairman, Lucknow Development Authority.

The UP RERA has received around 25,000 complaints against developers from home buyers. Out of these, around 9,500 are against 25 developers. From these 25 developers, the UP RERA has identified top 10 developers for action.

“We have sought details of properties of two developers from LDA. They have violated norms of RERA and have not fulfilled commitment made to home buyers,” said Rajive Kumar, chairman, UP RERA.

Action would be taken under Section 63 of the RERA Act, Kumar added.

Section 63 of the RERA Act, 2016, imposes penalty for failure to comply with orders of the Authority by a promoter.

Before taking action, the UP RERA will also convene a meeting with these developers.

The UP RERA has issued recovery challans to these 25 developers in 692 complaints. However, only in 172 cases complete or partial recovery could be made.
