HC orders opening of premises that Ambala MC had sealed
: The Punjab and Haryana high court has ordered the opening of a commercial premises (number 107) on the Railway Road.
The order that justice Jitender Chauhan issued on November 1, reads that the premises in question were allegedly ordered to be sealed by the joint commissioner of the MC on extraneous considerations.
In his petition, a resident Ravinder Garg had sought directions for the removal of the seal on the premises and compensation of ₹5 lakh for the illegality that the MC joint commissioner had committed. The plea had asserted that the premises were raised after the competent authority had sanctioned the plans.
The orders observe that the counsel for the petitioner has pointed out that there were personal allegations against the joint commissioner and he had been arrayed as an respondent by name.
It said that at the time of issue of the completion certificate, violations were noticed by the MC following which the petitioner had deposited compounding fee of more than ₹6 lakh, adding that the petitioner is not able to operate from the premises and was suffering from recurring losses.
The order also reads that keeping in view the fact that despite the opportunity availed by the respondents, no reply had been filed till date, the premises in question is ordered to be unlocked forthwith.
