NO POSSESSION: JIT TOLD TO REFUND MONEY TO 4 FLAT OWNERS

JALANDHAR:The district conumer redressal forum has ordered the Jalandhar Improvemen­t Trust (JIT) to refund around ₹20 lakh in total along with ₹1.4 lakh litigation and harassment expenses to four allottees of Bibi Bhani Complex over delay in handing over the possession of flats.

The trust was ordered to refund the amount paid by each allottees to them with 12% interest from the respective date of its deposit and ₹35,000 as compensati­on and litigation expenses to each of them.

Complainan­ts Sunil Bhatia and Gurmeet Singh had paid ₹5.33 lakh for the flat, Harpreet Singh ₹3.79 lakh and Gopal Krishan ₹6.26 lakh. However, they never got the possession of the flats.

In their complaints, they said they were allotted flats under the Vikas scheme, at Guru Amar Das Nagar here on August 16, 2009, through a lucky draw.

In the same year, they said, the complete payment of the flats, as per the agreement with the trust, was made and the allotment letter was issued in January 2010.

As per the letter, the trust had to complete the constructi­on within two-and-a-half year and thereafter the possession was to be delivered in 2012, they said.

“To date, the trust has not been able to complete the constructi­on in all respect, what to speak of the delivery of possession,” they claimed. A notice of the complaint was given to the JIT by the forum. However, JIT officials maintained that the complainan­ts themselves were at fault as they did not turn up to take the possession of the flats . Meanwhile, the forum contended that the trust was liable to handover the possession by 2012. However, it failed to bring the evidence, proving that the work of the flats had been completed and the same was fit for delivery.
