Violation: HC seeks final report on 1,246 Jamshedpur buildings
Jharkhand High Court (HC) on Wednesday directed the three-member legal probe panel to submit its final report on alleged violations of Jharkhand Building By-laws2016, deviations from approved designs and drawings and traffic rules in the construction of 1,246 buildings in Jamshedpur city, people aware of the development said on Wednesday.
“The HC division bench of justice Rangon Mukhopadhyay and justice Deepak Roshan heard the public interest litigation (PIL) (2078/2013) on Wednesday. The bench blasted the Jamshedpur Notified Area Committee (JNAC) for not taking any action against the violators and directed the three-member lawyers’ team appointed by the HC to submit its final investigation report in the HC. The next hearing will be held on April 9,” Akhilesh Srivastava, senior advocate representing petitioner Rakesh Jha told HT on Wednesday.
Akhilesh Srivastava further said the HC bench took serious note of the JNAC taking no punitive action against people who constructed buildings deviating from approved designs and drawings, commercial shops and stalls in the parkings etc.

“We told the court that JNAC had sealed 46 buildings for such violations in 2011, which meant that those were to be demolished. But JNAC removed the sealing as soon as the HC ordered the state to take action against the violators in WP PIL (1076/2011). This provided the builders to carry out construction of more illegal buildings, resulting in 1,246 illegal buildings in Jamshedpur where parkings are being used for commercial purposes while vehicles are being parked on roads,” said Srivastava.
The HC bench went through the interim report of the lawyers’ panel and directed the team to stay in Jamshedpur, complete investigation and submit final report.
The panel has been asked to focus on three points - the role of JNAC in uncontrolled construction of illegal buildings, action taken till date on the HC order in 2011 and the irregularities in approving drawings and amending them and the number of such illegal buildings.
