HC fixes 5-year posting for school teachers in Haryana

TELLS GOVERNMENT TO COLLECT DATA OF TENURE OF ALL TEACHERS AT A PLACE BEFORE ISSUING TRANSFER ORDERS

CHANDIGARH: In an order which will help in bringing uniformity and probity in transfers of school teachers across Haryana, the Punjab and Haryana high court has fixed a five-year term for teachers at a particular institutio­n.

The high court bench of justice Rajiv Narain Raina directed the director, secondary and elementary education department­s of Haryana, to collect data from all schools of the state about the length of posting of each teacher and make it available on the website.

The court further directed that till such exercise is not completed, the transfers of teachers should not be made and ordered that transfer orders could be issued in those cases, where employees have completed five-year tenure in their respective schools.

The high court has made it clear that if an employee has completed five years at a place, his post would be considered as “deemed vacant” and transfers would be made in that case only.

In other scenarios, the transfer of an employee with less than a five-year tenure at a place can be effected, if he or she has opted for it.

The court also stated that result of the exercise be made available on website in order to bring transparen­cy in the entire process.

The HC bench stated that the order was intended to bring about uniformity and parity in decision-making process so that all teachers were treated on the principle of “equality”.

The order came from the bench of justice Raina on the petitions, wherein teachers had alleged arbitrarin­ess, and political interferen­ce in transfers.

“This would obviate any apprehensi­on in the mind of the petitioner­s that there has been effort of some teachers suppressin­g facts regarding their tenure, of true facts which may not be available in public domain,” the HC bench observed.

The HC bench also said that it would help by not generating unnecessar­y litigation.

The court observed that when authoritie­s would order transfer of teachers by taking into account facts collected, those transferee­s would not have a heartburn as data would be available on website.

None of the employees would need to run from pillar to post and bring his case to light, armed with facts, the bench stated, asking the government not to make any transfer till the time exercise was completed. DHAR (MP): Three passengers were killed and 11 injured on Wednesday when their bus crashed into a stationary truck on Mhow-Neemuch road near Paankhedi village, a police official said.

“The Rajasthan Roadways bus on its way to Burhanpur from Udaipur hit a stationary truck, in which three persons including a woman were killed and 11 others injured,” Pithampur police station incharge, Mukesh Ijaardar said.

The deceased were identified as Neeta Joshi (23), Abid Hussain (27) and Naresh (23), he said.

The injured were referred to Indore for treatment, he said adding that the truck driver fled from the spot after the mishap.

A case has been registered in this regard and further investigat­ion is on.
