PGS worry residents, Tulip Purple developer gets notice
GURUGRAM: The Gurugram district town planning department (DTP) has sent a final reminder to the developer of Tulip Purple, a residential group housing society in Sector 69, on Friday, asking it to put an end to the practice of allowing residential flats for paying guests (PGS) in one of its towers, as it violates the Haryana Development and Regulation of Urban Areas Act of 1975.
Tulip Infrastructure Private Limited, a real estate company, developed Tulip Purple between 2009 and 2017 with seven towers and around 500 flats. More than 50% of flats in the residential complex are currently occupied.
Confirming the complaints in this regard, KM Pandurang, director-general, town and country planning(dg-tcp), Haryana government, said that PG accommodations are considered as commercial activities and not allowed in the residential flats.
“I have sought a report from the local office. PGS or commercial activities in any residential flat/house in the city are illegal. It will not be allowed,” said Pandurang.
The DTP sent a show-cause notice to the developer in June this year after residents of the society raised a complaint of nuisance of people living in PGS in one of its towers, B5. However, the notice did not elicit any response. The DTP in October sent a second reminder to the developer.
“We have sent a final reminder to the developer to stop commercial activities in the premises, failing which we will take action as per 1975 Act,” said a senior DTP official familiar with the matter.
The show-cause notice stated that all the seven towers of the complex are residential houses/ flats and cannot be used for PGS accommodation, which is a commercial activity and for which the developer did not obtain the necessary permission from the department.
Pravin Jai n, managing director of Tulip Infrastructure Private Limited, said, “We have no role in leasing out the tower in question to PG accommodations. The act has been done by a company which has been handed over the flats by us. However, being licencee of the project, we have asked the competent authority to take action as per the law.”
The residents said in their complaint they spotted advertisements for PGS with Tulip Purple address.
“We also noticed that some walls on the ground floor of Tower 5 of Block B were being dismantled. When we queried, we came to know that this was being done to make room for a big kitchen, gymnasium etc. We spoke to the developer and he confirmed that the entire tower was for paying guests only. We lodged complaints with the DTP, the town and country planning department (TCP), the chief minister’s office and the police. Following our repeated complaints, a team of officials from the local DTP office removed the advertisements but the PGS are still there and many people are living in them. They are a big nuisance. They beat up our security guards one night and threw dirt on them. This cannot be tolerated,” said Durgesh Mishra, a resident.
