MUMBAI: A 54-year-old businessman from Goregaon has been sentenced to one-year jail term and fined ₹5,000 by the Girgaon metropolitan court for assaulting an on-duty traffic constable. The incident took place in August 2015, when the constable Mahendra Pardeshi was guiding traffic near Babulnath temple in south Mumbai.

The convict Ramesh Badasiwal, who was driving a car, was entering from a no-entry route when Pardeshi tried to stop him, the prosecution told the court.. Pardeshi tried to direct him towards the proper route but Badasiwal did not comply.

After the constable began to whistle, Badasiwal verbally abused him.

Pardeshi, in his testimony, told the court that Badasiwal held him by the collar and assaulted him. He said Badasiwal landed blows on his chest and stomach.

During cross examination of a witness, it was revealed that Badasiwal had been in a hurry as his elderly mother had urinated in the car. Advocate Kamlesh More, representing Badasiwal, argued that the constable had assaulted the defendant.

Taking into account the lack of injury marks on Badasiwal, the constable’s blood-soaked uniform, and the doctor’s testimony, the court convicted the accused.

“It cannot be forgotten that informant is a public servant and a great amount of dignity and credibility gets attached to any public servant,” magistrate AR Rahane observed in the order.
