Allahabad HC stays allotment of 1,000 flats in Supertech project in Gr Noida

ALLAHABAD/NEW DELHI: The Allahabad High Court on Wednesday stayed allotment of more than 1,000 flats in Supertech Czar Suites luxury apartments at Greater Noida after allegation­s that proper sanction was not obtained for their constructi­on.

A Division Bench comprising Chief Justice D B Bhosale and Justice Yashwant Verma passed the order on a petition filed by V K Sharma and eight others who had invested in the housing project.

The petitioner­s moved the court alleging that the housing project, coming up in Sector Omnicon 1 of Greater Noida, was launched in 2007 with a sanction for only 844 flats from Greater Noida Authority.

However, according to the petitioner­s, the builders went on to construct a total of 1904 flats and applied for a revised sanction afterwards with a view to getting the “illegal” constructi­ons legalized.

Fixing February 8 as the next date of hearing in the matter, the court directed the Greater Noida Authority not to issue the certificat­e of completion to the builder and take appropriat­e action in accordance with law. The court directed that none of the buyers of the flats in question be given possession for the same and cases of possession having been already given, shall be subject to the outcome of the writ petition. The court also asked the Greater Noida Authority to ensure presence of one of its officers on the next date of hearing to assist the court with facts relating to the case.
