Treatment by unqualifie­d man leads to death of toddler

NEW DELHI: The treatment given by an unqualifie­d person to a baby resulted in her death in South West Delhi area. Police claimed that they have arrested the accused after conducting an investigat­ion into the case.

According to police, the accused identified as Vijay Kumar Tiwari was booked under sections 304 A (Causing death by negligence), 420 (Cheating and dishonestl­y inducing delivery of property) and section 27 of Delhi Medical Council Act, 1997.

Seeking clarificat­ion on the treatment administer­ed by Tiwari to the baby which apparently resulted in her death, the Kapashera police station on April 13 approached Delhi Medical Council (DMC). “It was observed based on records available in the office that Vijay is not registered with DMC,” said Doctor Girish Tyagi from DMC.

It was further observed that in terms of section 15 (3) with section 15 (6) of Delhi Medical Council Act 1997, the only person who possesses recognized medical qualificat­ion as per schedule of first, second or third to the Indian Medical Council Act 1956 and is registered with DMC as per that DMC Act 1997 is entitled to practice modern scientific system of medicine (allopathy) in NCT of Delhi. Tiwari being the holder of Bachelor of Electro-homeopathy Medicine and Surgery and holding registrati­on with Council of ElectroHom­eopathy Medicine and Surgery is neither qualified nor authorized to practice the allopathic system of medicine.

Police claimed that it was found that Tiwari was an unqualifie­d person acted recklessly by administer­ing allopathic medicine which was beyond his knowledge, skill and competence, with scant regard to the life and safety of the patient and that the actions on the part of Tiwari constitute an act of criminal negligence for which he is liable to be prosecuted under relevant provisions of Indian Penal of Code (IPC) in addition to 27 section of DMC ACT.

Confirming the arrest, Deputy Commission­er of Police (South West) Devender Arya stated that the accused was arrested after proper investigat­ion.

A case of medical negligence in 2017 in East Delhi when the doctors of a private hospital declared a baby dead but he was found to be alive later. The case was later transferre­d to Crime Branch of Delhi Police. The police questioned the hospital staffs in this regard.
