GANGRAPE VICTIM TURNS HOSTILE, FIVE ACQUITTED

New Delhi: A Delhi court has

acquitted five men of chages of gangraping a 15year- old girl after the victim failed to identify them and turned hostile. “The victim has not supported the prosecutio­n case by deposing that she did nto make any complaint to the police. She did not go anywhere and did not want to say any

thing,” the court noted while acquitting Rahul, Amit Kumar, Anuj, Deepak and

Chandan Sharma of the charges punishable under Section 376 ( D) of the IPC

and 4 and 6 of the Protection of Child from the

sexual offence. The court noted that the girl

stated that she made the statement before the magistrate at the instance of the

investigat­ion officer and whatever she stated in the statement was false. The victim also told the court

that she had seen the accused persons first time in

the court and did not file any complaint against them.

The court noted that the prosecutri­x and other material witnesses who were mother and father of the victim, had not supported prosecutio­n case either in examinatio­n in chief or in cross- examinatio­n. In fact, the parents of the girl had deposed that the accused person did not do anything wrong with their daughter. According to the prosecutio­n, on June 21, 2014, the accused persons in furtheranc­e of their common intention committed rape upon

the minor girl. All the accused were arrested by

the police.
