2G scam: CBI plans to make fresh appeal in HC

Probe body also to appeal Talwars’ acquittal

After receiving a formal approval from the Union law ministry, the CBI is now preparing to file an appeal in the 2G scam case wherein all the accused were acquitted by the trial court in the high court. Besides, the agency will also go for an appeal against the recent acquittal of Rajesh and Nupur Talwar in the twin murder cases of their daughter Aarushi and domestic help Hemraj in 2008 by the Allahabad high court.

“The agency sleuths are in constant touch with the senior officials of the prosecution wing of the CBI. The agency sleuths are finalising appeals in both cases and they are expected to be filed next week,” sources said.

O. P. Saini, recently acquitted all 16 accused, including former communications minister A. Raja and DMK MP Kanimozhi in the 2G scam case. Immediately after the trial court order, the CBI had announced that “it prima facie examined the order and it appears that the evidence adduced to substantiate the charges by the prosecution has not been appreciated in its proper perspective by the court”.

The Union law ministry, sources said, also advised the Central probe agency to file a special leave petition in the Supreme Court challenging the Allahabad high court’s decision in the Aarushi- Hemraj double murder case.

The high court acquitted Rajesh and Nupur Talwar in the double murder case. Hemraj’s wife had also moved the Supreme Court last month, challenging the acquittal of the dentist couple by the high court.

“Neither the circumstances nor the evidence was enough to hold them ( Talwars) guilty”, the high court had said in its order.

In its 273- page verdict acquitting the dentist couple, the high court had said the prosecution “miserably failed” to prove that the Talwars had destroyed material evidence.
