SC to hear plea to quash FIR against Army officer
The Supreme Court on Thursday agreed to hear on Friday a writ petition filed by Lt. Col. Karamveer Singh, a decorated Army Officer, to quash the FIR registered by the Jammu and Kashmir government against his son in the Army when he was performing his duties in defending the country.
A Bench of Chief Justice Dipak Misra and Justices A. M Kanwilkar and D. Y. Chandrachud accepted the urgent mention made by counsel Aishwarya Bhati for early listing of the petition considering the importance.
The petitioner said he was filing this petition on behalf of his son, Major Aditya Kumar, for protecting the morale of the soldiers of Indian Army, who are facing all odds in performance of their bonafide duties and laying their lives in the line of duty, to uphold the dignity of the Indian Flag.
He said he is constrained to file the present Writ Petition for quashing of the FIR, directly before this Court in view of the extremely hostile situation on the ground, whereby an FIR has been registered by the local police against his son who is a service Army Officer and was performing his bonafide duties as directed by the Union of India.
The petitioner said his son Aditya Kumar of 10 Garhwal Rifles, was wrongly named in FIR No. 26/ 2018 dated 27.01.2018, P. S. Shopian under sections 336, 307, 302 of the Ranbir Penal Code.
