Quash resolution moved by AAP legislator: BJP

Leader of Opposition in Delhi Assembly, Vijender Gupta, and other BJP MLAs on Tuesday filed a writ petition in the Delhi high court seeking quashing of the resolution moved by AAP legislator Saurabh Bhardwaj on March 26 directing the government to present the outcome report of lieutenant­governor’s office on the lines of the Outcome Budget presented by the government in the recently concluded Budget session.

The petition seeks quashing of the resolution on the grounds that it violates the Assembly Rule 93 ( VI), sanctified by the Constituti­on of India.

Objecting to the above Resolution, the Opposition submitted a letter to the Speaker on April 5 outlining its objections.

However, the Speaker overruled the objections in the House on April 6.

The Opposition MLAs walked out of the House in protest against the Speaker's ruling. They visited L- G Anil Bansal immediatel­y and apprised him of the violation of rules in the Assembly.

Besides seeking quashing the resolution dated March 26, the petition also seeks quashing the outcome report and ruling dated April 6 passed by the Speaker. The petition also prayed to pass any other order in the interest of justice.

Mr Gupta claimed that the petition will come up for hearing tomorrow.

The BJP MLAs pointed out Mr Bharadwaj moved the resolution directing Delhi government to present a status report of the L- G’s office on the lines of Outcome Budget.

It further said that the report should mention the files which have been delayed or blocked by the L- G’s office. They drew the Speaker’s attention to the Rule 93( 6) and 264 ( 2) ( f), which states the House cannot make adverse comments on the working or conduct of the L- G.

“The outcome report and the comments thereon are strictly against the rules of the Delhi Legislativ­e Assembly and the spirit of the Constituti­on,” said Mr Gupta.
