FIR lodged in Kailash Kher case

Pursuant to the directions from the Bombay High Court, the DN Nagar police registered a First Informatio­n Report (FIR) against three businessme­n, who allegedly duped Bollywood and Sufi singer Kailash Kher of Rs. 3.50 crore.

The FIR was registered late on Saturday night after recording Kher’s statements in context of the alleged offence.

It may be recalled that the ‘Teri Deewani’ fame Kher, had approached the DN Nagar police seeking to register an FIR but the police had refused to take his complaint, following which the singer reached HC.

Kher had filed a writ petition in the HC seeking directions to the DN Nagar police station to file an FIR against the three businessme­n.

According to Kher, the three alleged accused (as named in the petition) – Vijay Kumar Singh, Anand Kishor Choudhary and Bart Pinto – had in December 2015 promised him a lavished office in Versova’s ‘Jai Ambe’ building, which also houses offices of many other celebritie­s from Btown. The accused had also prepared and signed a Memorandum of Understand­ing (MoU) for the deal and Kher had paid Rs. 1.50 crore to them.

While speaking to the Free Press Journal, Ashok Saraogi, the lawyer representi­ng Kher said, “As per the MoU, the accused had to hand over the possession of the said office to my client for the remaining payment, however when my client went there, he saw that the office was sealed by a bank. It was later learnt that the office was mortgaged by the accused and sold the same without informing my client about it. They were aware that the bank might seal the property and still went on to sell the said office.”

Even while arguing in the HC, Saraogi had termed this is case as a clear ‘cheating’ case.

On Thursday, the Bombay HC’s division bench presided over by Justice Naresh Patil and Justice Prakash Naik, had pulled up the police officials of the DN Nagar police station for their inaction and had directed them to initiate action in accordance with law.

When enquired with the DN Nagar police station, API Sandeep Geete, the investigat­ing officer of the case said, “We have recorded Kher’s statements and an FIR has been filed in the case.”

Interestin­gly, to the reasons best known to them, the officials in the Mumbai Police department, including DCP Ashok Dudhe (who is the spokespers­on of Mumbai Police), were unable to comment on the sections under which the FIR has been lodged and they were also seen refraining themselves from revealing further details.
