SoBo man drags MMRCL to court for high decibel work
In what can spell trouble for the Mumbai Metro Rail Corporation Limited (MMRCL) Metro line 3, a man has dragged the firm to the Bombay High court seeking compensation for ‘sleepless’ nights. The man has sought a compensation of Rs 10,000 per day for him, his wife and two daughters for their hardships and sufferings owing to the continuous construction activity in their vicinity. The Cuffe Parade-based resident, Robin Jaisinghani (50) has approached the division bench headed by Chief Justice Manjula Chellur seeking directions to the MMRCL to stop its construction activities in his vicinity, during the night time.
Jaisinghani’s counsel mentioned his plea before the bench of Chief Justice Chellur on Wednesday, saying that the MMRCL has flouted the norms of the Noise Pollution Rules, 2000.
In his petition, Jaisinghani has claimed that the construction work carried out by the MMRCL at night hours, exceeds the permissible limit of 45 decibels. The petition reads, “As per the Noise Pollution Rules, the permissible limit is 55 in day and 45 in night but the MMRC is continuously disregarding the law. The construction work exceeds 60 decibels that is clearly violating the Noise Pollution Rules, 2000.”
The petition also cites the detailed judgement passed by a division bench of Justice Abhay Oka and Justice Amjad Sayed in a bunch of petitions seeking effective implementations of the Noise Pollution Rules, 2000. The petition states that the MMRCL and its contractors have breached the judgement too.
Citing the conditions imposed by Maharashtra Coastal Zone Management Authority (MCZMA) while allowing MMRCL to construct the metro line in Cuffe Parade area (that falls under CRZ), the petition states that the authority has flouted the condition too.
“The condition imposed by the MCZMA is that the MMRCL will have to ensure that the construction work is not exceeding the permissible limits,” the petition reads.
The petition also states that despite several complaints made by Jaisinghani, none of the concerned authorities have taken any action against the MMRCL and its contractors.
