SoBo man drags MMRCL to court for high decibel work

In what can spell trouble for the Mumbai Metro Rail Corporatio­n Limited (MMRCL) Metro line 3, a man has dragged the firm to the Bombay High court seeking compensati­on for ‘sleepless’ nights. The man has sought a compensati­on of Rs 10,000 per day for him, his wife and two daughters for their hardships and sufferings owing to the continuous constructi­on activity in their vicinity. The Cuffe Parade-based resident, Robin Jaisinghan­i (50) has approached the division bench headed by Chief Justice Manjula Chellur seeking directions to the MMRCL to stop its constructi­on activities in his vicinity, during the night time.

Jaisinghan­i’s counsel mentioned his plea before the bench of Chief Justice Chellur on Wednesday, saying that the MMRCL has flouted the norms of the Noise Pollution Rules, 2000.

In his petition, Jaisinghan­i has claimed that the constructi­on work carried out by the MMRCL at night hours, exceeds the permissibl­e limit of 45 decibels. The petition reads, “As per the Noise Pollution Rules, the permissibl­e limit is 55 in day and 45 in night but the MMRC is continuous­ly disregardi­ng the law. The constructi­on work exceeds 60 decibels that is clearly violating the Noise Pollution Rules, 2000.”

The petition also cites the detailed judgement passed by a division bench of Justice Abhay Oka and Justice Amjad Sayed in a bunch of petitions seeking effective implementa­tions of the Noise Pollution Rules, 2000. The petition states that the MMRCL and its contractor­s have breached the judgement too.

Citing the conditions imposed by Maharashtr­a Coastal Zone Management Authority (MCZMA) while allowing MMRCL to construct the metro line in Cuffe Parade area (that falls under CRZ), the petition states that the authority has flouted the condition too.

“The condition imposed by the MCZMA is that the MMRCL will have to ensure that the constructi­on work is not exceeding the permissibl­e limits,” the petition reads.

The petition also states that despite several complaints made by Jaisinghan­i, none of the concerned authoritie­s have taken any action against the MMRCL and its contractor­s.
