OC no longer mandatory for Hsg Societies

In a move that will give major relief to nearly 50,000 housing societies in the Mumbai Metropolitan Region, the state government has agreed to waive the prerequisite of having an Occupancy Certificate for getting the deemed conveyance of the plot.

Earlier, the officials at the registrar’s office insisted that housing societies must submit the OC along with other documents to obtain ownership of the plot.In a recent Government Resolution, the state government has said that housing societies will not require OC to get the deemed conveyance. Approximately 18,000 societies in the island city and 30, 000 societies in the suburbs were struggling to get the deemed conveyance in order to redevelop their structures.

The expert added that developers avoid giving the deemed conveyance to housing societies in order to have control of open spaces, parking space and other such areas.

BJP city president Ashish Shelar had tabled this proposal in a meeting with Chief Minister Devendra Fadnavis. Shelar had tweeted in July that the housing societies will now be relieved since the government has agreed to modify the OC conditions.

The Occupancy Certificate is issued by the local civic body for a building. The developer is issued OC when he has met all the conditions of the civic body.Conveyance of a property entails the transfer of the rights and ownership of the property from the seller to the purchaser. Even after selling the flats, some developers still hold onto the ownership of the plot. This deters housing societies from carrying out various other works. Prakash Kadam, a resident of a housing society and a member of the society's committee, said, “We want to stop this malpractice. The unscrupulous developers were misusing the right.”
