RERA forces developer to revise possession date

In yet another complaint against a city developer for pushing back flat possession dates, a home buyer has approached the Real Estate Regulatory Authority (RERA) after the developer failed to give possession of the flat for five years. The complainan­t, Balu Bawar, told the RERA bench that he does not wish to continue investing in the project after the developer, Neptune Developers, delayed the project.

According to Bawar, he had booked a flat in Neptune Swarajya sector 2-B 14 under a registered agreement for sale dated December 2012. He alleged that the respondent has failed to give possession of the said flat even after five years since the signing of the agreement.

He told the authoritie­s that the developer while registerin­g the project in MahaRERA, has mentioned the revised proposed date of completion December 2018 because of which he is unwilling to continue in this project.

The developer accepted the delays and explained that the completion of the project has got delayed due to several reasons that are beyond his control. The developer expressed his willingnes­s to push forth the possession dates. The complainan­t and the developer mutually agreed to a possession date on March 2018.

The authority then directed the developer to handover the possession of the flat to the complainan­t before the agreed fresh date. The authority stated that if the developer fails to give possession on the said date, then he will have to pay interest from April 2018 till the date of possession on the entire amount paid by the complainan­t.

RERA officials were unavailabl­e for a comment when contacted.
