Police inaction forces deceased advocate to file a writ at the HC

The advocate of Sachin Jaiswar, the 17-year-old who died at Lokmanya Tilak Hospital on July 21, will be filing a writ petition at the Bombay High Court by Thursday since Dharavi Police “have not been co-operating in registerin­g a First Informatio­n Report (FIR) in the death of Sachin”.

The Jaiswars have alleged that Sachin died due to torture by Dharavi police after being detained inside a toilet at the police station for 22 hours, from the night of July 13 to July 14.

Speaking to The Free Press Journal, advocate Moin Khan, who is representi­ng the Sachin’s family, alleged, “The police have refused to file a First Informatio­n Report (FIR) in this matter. We have dispatched letters on Monday to the Chief Minister Devendra Fadnavis and to the Deputy Commission­er of Police (Zone 5). As a procedure, I need to wait for 48 hours to move the high court. If the demands for an independen­t inquiry and filing of the FIR are not met, we will move the court by Thursday to issue an order for a FIR.”

“My client is unaware about the status of the case. The police are not disclosing anything to my client, "added Khan. Sunil Jaiswar, Sachin's brother alleged, "We have tried to file an FIR at the Dharavi police station but the police have not taken our complaint.”

Sachin’s father Ravindra had written a letter to the Chief Minister on Monday, stating, “My son was let off on July 14 at 10pm by Dharavi police only after his condition worsened due to the torture during detention at the police station. He was detained inside a toilet at the police station where he was beaten up brutally with batons, belts, bare hands and kicked by the police. He had developed physical injuries on his hands, legs, chest and head after he was let off by the police. My son died at Lokmanya Tilak Hospital at Sion on Saturday night. As per the doctors, my son died due to leptospiro­sis. However, the Dharavi police are responsibl­e for his death. My son was tortured inside the toilet by the police since my family belongs to the scheduled caste”.

According to Rajeev Jain, Deputy Commission­er of Police (Zone 5), “We have received the letter on Monday. An inquiry will be conducted in this matter.”

The police have refused to file a FIR in this matter. We have dispatched letters on Monday to CM Fadnavis also to the DCP (Zone 5). As a procedure, I need to wait for 48 hours to move the high court. If demands for an independen­t inquiry and filing of the FIR are not met, we will move the court by Thursday - Moin Khan, Lawyer
