Estranged spouse booked for triple talaq

In the first case registered in Mumbai for triple talaq, a 32-year-old Muslim woman has registered a case against her 53-year-old estranged husband for allegedly giving her a triple talaq. The triple talaq is a punishable offence after the government cleared an ordinance on September 20.

A First Informatio­n Report (FIR) has been registered on Saturday at the Trombay police station against Mohammed Umar Shaikh (53), the husband of the victim Kanees (32) and Mohammed Umar Shaikh (53) had married on April 28,2017.At the time of marriage, Shafiq Shaikh, the father of Kanees had given his daughter a necklace, two pairs of earrings and a ring worth Rs 1.20 lakh which Umar had snatched away from her after the marriage. Umar has been booked for husband or relative of husband of a woman subjecting her to cruelty (Section 498 (A)), criminal breach of trust (Section 406), voluntaril­y causing hurt (Section 323) and intentiona­l insult with intent to provoke breach of peace (Section 504) of the IPC and mahr or other properties of Muslim woman to be given to her at the time of divorce (Section 3) and order for payment of maintenanc­e (Sec 4 of the Muslim Women (Protection of Rights on Marriage) Act.

On September 20 this year, Umar visited his in-laws home at Cheetah camp, Trombay, where he assaulted Shakila (30), the sister of Kanees and tore off her clothes. He even threatened and attacked Shameem (18), the brother of Kanees who intervened. He said talaq talaq talaq thrice in front of her parents and siblings. Kanees alleged when Umar was called to police station, he admitted he spoke the words ‘talaq’ thrice.
