Sheila son-in-law in HC against wife, cops

SYED MOHAMMAD Imran, the son-in-law of former Delhi chief minister Sheila Dikshit, Wednesday moved the Delhi High Court seeking contempt of court action against senior police officers for “vexatiousl­y and illegally” arresting him after an FIR was filed against him by his estranged wife Latika. He has also sought contempt of court action against Latika.

The plea alleges that the police had “brazenly” violated the procedure for arrest laid down by the Supreme Court by not giving him notice of investigat­ion required under provisions relating to matrimonia­l disputes, and had lodged a “false” FIR under provisions of cheating, theft and misappropr­iation of property even though the “genesis of the complaint” relates to a matrimonia­l dispute.

He said police acted at the behest of his wife, who is from an “influentia­l political family”.

Advocates Prosenjit Banerjee and Neeraj Kumar, appearing for Imran, argued in court that a false and fabricated FIR was lodged against him and that he was wrongfully confined for 15 days.

The FIR does not disclose commission of any offence under IPC sections 420 (cheating), 403 (dishonestm­isappropri­ationofpro­perty)and380(theft)read with section 66 of the IT Act, he said.

The court asked Imran’s counsel to show the law which says if a section is not added at the time of lodging of an FIR, fresh sections cannot be invoked later. It posted the matter for further hearing to December 15.
