Man admits GBH over baby’s fall from window

A MAN has pleaded guilty to a lesser charge in the case of a baby boy who fell from an upstairs window.

Timuras Kozlov had been accused of attempted murder, which he denied, but he admitted unlawfully inflicting grievous bodily harm on the child.

Kozlov, of Derrychara Drive, Enniskille­n, but in custody since his arrest, appeared at Dungannon Crown Court yesterday.

Originally from Lithuania, the 21-year-old had been accused of attempting to murder the baby — who was six months old at the time — on the evening of May 6, 2017, at an address in Castlecool­e Road, Enniskille­n.

It had been alleged the child was thrown from a second floor window, although Kozlov always insisted the fall was accidental, and last week pleaded not guilty to attempted murder.

The case was then relisted at court, and counsel for the prosecutio­n said an amended charge had been agreed following legal discussion­s.

Defence counsel asked for his client to be arraigned on the new charge of unlawfully inflicting grievous bodily harm on the child, which Kozlov accepted.

The defence emphasised the guilty plea was “on an agreed statement of facts on the basis of recklessne­ss”.

Prosecutio­n counsel asked for the attempted murder charge to be left on the court books and not to be proceeded with.

His Honour Judge Stephen Fowler QC remanded Kozlov in continuing custody while pre-sentence reports are prepared.
