Speedingcase struckout
The case of a man accused of speeding was struck out at Arklow District Court after the defendant told the court that he was not driving and that his friend, now deceased, may have been responsible.
Aidan Woods of 2 Bramley Way Castleknock, Dublin 15, was accused of speeding at 92km/h in a 80km/h zone at N11 Johnstown South, Arklow, on June 20, 2015.
Mr Woods told the court that after he received the fine, he sought clarification from the issuing office, which asked him to forward a photograph of his vehicle. He said that he did as requested but never heard any more about the matter until he was summonsed to court.
The defendant told the court that the date in question was his wedding anniversary and that he and his wife ‘tend to try and get away’ and therefore he was not at home or driving the vehicle when the offence occurred.
Judge David Kennedy asked if anyone else could have had access to the vehicle, and Mr Woods replied that his friend might have, but that he is now deceased.
There was also a question regarding a horsebox which was photographed hitched to the jeep when the speeding was detected.
Mr Woods said he never had a horsebox and lives in a housing estate, but that his late friend did.
Judge Kennedy said that there was a doubt and therefore struck out the matter.
