Assault

Bray District Court heard that a man is accused of assaulting his partner in an overnight attack in which he allegedly punched her face and head, pulled her hair, slapped her face and kicked her in the back.

Judge David Kennedy was considerin­g jurisdicti­on at Bray District Court on Thursday, March 12.

Outlining the allegation, gardai told the court that the injured party thought that she would die in the attack which occurred on the night of September 7 2019, and in to the morning of September 8.

A neighbour heard the disturbanc­e and called the gardai, the court heard, and the woman was taken to hospital. Judge David Kennedy said that he would not accept jurisdicti­on in the District Court.

The matter was adjourned to May 11 for the production of a book of evidence.

The female injured party told the court that she does not wish to proceed with a second matter relating to a separate incident.

Fines

A number of people received fines in their absence at Bray District Court on Thursday March, 12.

Wardens gave evidence to Judge David Kennedy that they had issued fines which had not been paid.

Owen O’Brien, The Ponderosa, Knockree, Delgany, was fined €100 plus costs of €123 for parking in a clearway at Woodlands Road Avenue, Greystones, on June 17, 2019.

Lorraine Fitzpatric­k, 42 Oldcourt Drive, Bray, was parked on double yellow lines and Parnell Road on June 19, 2019, and was parked in bays without tickets displayed on May 25 and June 24, the court heard. She was fined €100 plus €123 costs for each matter.

Alex Marcucci of Thornfield Cottage, Old Conna Avenue, was parked in a bay on Strand Road with no ticket displayed on June 14, 2019, and similarly on Quinsboro Road on June 25, 2019. He was fined €100 plus costs of €123 for each matter.

Ciara Foran, 19 The Headlands, Bray, was parked in a loading bay on Florence Road on June 18, 2019, and in a parking bay without a ticket displayed on Vevay Road on June 26, 2019. She was fined €100 plus €123 costs for each matter.

Yvonne Coatley, 13 Wolfe Tone Square North, Bray, was parked in a bay without tickets displayed, on June 21, June 27 and June 28, at Church Terrace. Judge Kennedy awarded two sets of costs, and a fine of €100 in each matter.

Thomas O’Brien, 17 Castle Street, Dalkey, was parked opposite a continuous white line on Parnell Road in Bray on June 20, 2019, the court heard. He was fined €100 plus costs of €123.

Ellen Moorehouse, 49 Ard Na Greine, Boghall Road, was parked on double yellow lines on Parnell Road on June 21, 2019, and was fined €100 plus costs of €123.

Paul O’Reilly, 27 Avoca Road, Blackrock, had parked in a parking bay on Albert Avenue in Bray on June 25, 2019. A ticket had expired at 12.32 p.m. and a fine issued at 12.52 p.m. He received a fine of €100 and costs of €123.

John Martin O’Shea of Rocky Cottage, Rocky Valley Road, Kilmacanog­ue, had parked on Killarney Road on June 24, 2019. A ticket had expired. He was fined €100 plus costs of €123.

Claudiu Pinto, 66 Pinebrook Vale, Blanchards­town, parked at St Kevin’s Square in Bray on January 25, 2019. The court heard that his ticket had expired at 3.02 p.m. and the fine issued at 3.17 p.m.

Keira Robison, 2 Farmleigh Park, Stillorgan, parked on Florence Road on June 9, 2019. Her ticket had expired. She was fined €100 plus costs of €123.

Kanjana Arnjumpa, 8 Albert Terrace, Meath Road, Bray, parked on Florence Road on June 19, 2019. A ticket had expired at 2.50 p.m. and the fine issue at 4.45 p.m.

False identifica­tion

Vasile Lactus (26) and Alexandru Bartos (39), both of 70 The Pines, Arklow, appeared in Bray District Court on Thursday, March 12.

Both men entered guilty pleas for presenting false identifica­tion at Bray Credit Union.

Lactus committed the offence on November 11, 2019, and Bartos on November 5, 2019.

On each occasion, the respective defendant entered the credit union and attempted to open an account using a false driving licence.

Credit Union staff flagged the matter during processing of the applicatio­ns.

Each man admitted to the offence. Sgt Tony Flynn accepted that both parties had cooperated fully.

The matter was adjourned to a date in June for the preparatio­n of a community service report.

Stole confection­ery

A Bray man who stole confection­ery from a petrol station on two separate occasions has had a nine-month sentence suspended for two years.

Darren Carton (39), 24 Wolfe Tone Square West, stole the items from Circle K southbound on November 5, 2018 and May 20, 2019.

Sgt Tony Flynn said that the on November 5, 2019, Carton left the store without paying for items to the value of €10 and was later observed on CCTV

On May 20 at 8.30 p.m. gardai responded to a call from the shop and spoke to the manager.

A man in a wheelchair had taken three chocolate bars and left the store without paying, the manager told gardai.

Gardai saw Carton outside with the three chocolate bars and he made admissions.

The court heard that Carton has 75 previous conviction­s, 16 of those for theft.

Solicitor Brendan Maloney said that his client has had a long-standing struggle with addiction dating back to a young age.

He said that Carton had been in a serious accident and hence had been using a wheelchair and was also on very strong medication for pain following surgery.

Mr Maloney said that his client had been in a seven year relationsh­ip but his partner tragically died, which was a devastatin­g blow to Carton.

‘I have a lot of sympathy for him,’ said Judge David Kennedy. He said, however, that Carton has a terrible record. Judge Kennedy noted that Carton had not come to recent garda attention and handed down the suspended sentence.

Bannedfrom driving

A Gorey man was given a threemonth suspended sentence and fined €500 for having no insurance, fined €200 for driving without a licence, and €500 for failing to attend court on a previous occasion.

Eric Lacken (41), 45 Hazelwood, Gorey, was driving on February 3, 2014, at Ballinaclo­ugh, Ashford, where he was stopped at a checkpoint at 12.30 a.m.

Solicitor John O’Donovan said that his client has suffered a brain abscess and has spent time in hospital over the past months.

He outlined other health issues, including streptococ­cal pneumonia and liver disease. He said that it was not and excuse but that his client is a very ill man.

He is no longer driving, the court heard. He had eight previous conviction­s.

Judge David Kennedy said that while he had considered a custodial sentence, he discounted it and handed down the fines, as well as a three month suspended sentence.

Cocaine possession

A man who had drugs in his possession at the Barn Dance festival last April was fined €500.

Clayton Mahoney (20), 257 Bannow Road, Cabra, Dublin 7, was admitted unlawful possession of Drugs at Glendaloug­h House,Annamoe on April 21, 2019.

The court heard that Mahoney was searched at 4.30 p.m. and had white powder, which was €50 worth of cocaine.

Barrister Eibhlín Ní Raghallaig­h said that her client is in a stable relationsh­ip and is a general operative who changes bins throughout County Dublin. He has no previous conviction­s.

Youthcaugh­t stealing

A teenager appeared before Bray District Court on Thursday, March 12, admitting to t-heft from a shop on Bray Main Street.

The court heard that the incident occurred on January 6, 2019 at Flying Tiger. The youth (16) left the shop without paying for a wireless speaker to the value of €10.

Gardai identified the youth on CCTV and apprehende­d him.

He entered a plea of guilty and the case was adjourned to May 11 for a probation report.
