35-year-old is charged with serious assault causing harm

A 35-YEAR-OLD MAN was charged at Waterford District Court on Monday morning with assaulting Jay Banville causing him harm in the city on Saturday.

Juraci Da Silva, 35, of John’s Lane Apartments, Waterford city, appeared at the courthouse at the The Gracedieu Manor Retreat House building on the Tramore road shortly before 11 a.m., wearing a grey hoodie and tracksuit pants.

James Banville, 28, from Raheen near Clonroche, was pronounced dead at University Hospital Waterford on Saturday.

Da Silva was charged before Judge Kevin Staunton with assaulting Mr Banville causing him harm at New Street, Waterford City, on Saturday, assulting Conor Hogan causing him harm, and in the course of a fight producing in a manner likely unlawfully to intimidate another person any article capable of inflicting serious injury, to wit a knife, at New Street, Waterford City on Saturday.

The defendant remained seated throughout the hearing in the courtroom where family members of Mr Banville were gathered.

Detective Sergeant Donal O’Donoghue told Judge Staunton that Da Silva is a Brazilian national who was arrested and formally charged on Sunday in relation to the three offences.

He said: ‘I cautioned him and he made no reply to the charges.’

Inspector Anthony Dineen said he was strongly objecting to bail, applying for the defendant to be remanded in custody.’

Defending solicitor Kenneth Cunningham said he spoke to DA Silva on a number ofr occasions over the weekend, adding that he wa reserving his position in relation to the bail applicatio­n.

Mr Cunningham said: ‘It will be our position to seek bail at a future date.’

His request for the case tio be adjourned to Thursday at Waterford District Court was approved by the judge, who remanded Da Silva in custody until Thursday. He also granted the defendant legal aid before he was led from the courthouse.
