Fault on both sides in accident
A CRASH that occurred in teeming rain more than two and a half years ago was reviewed by Judge Bernadette Owens at a civil sitting of the District Court.
The accident took place shortly after Darren Sweeney of Booley Green in Bunclody collected two children from a child minder’s house.
He was then poised to turn right off the main road as he headed for home a mile away.
However, he was then overtaken by a car driven by Elizabeth Farrell of Hollybrook, Tamona, Kiltealy which clipped his vehicle.
The result was €3,116 worth of damage for Sweeney and €1,242 for Ms Farrell.
After hearing sworn evidence from the two motorists, Judge Owens felt that Ms Farrell was 60 per cent to blame and made out decrees accordingly.
The court concluded that there appeared to be fault on both sides.
It was noted that Ms Farrell overtook at junction and that she appeared to be going at a speed which did not allow her adjust safely to the situation in which she found herself.
The accident took place in September of 2015.
