Woman successful­ly appeals her two-year disqualifi­cation

A MOTORIST was successful in her appeal to have a two-year disqualifi­cation for driving without insurance removed.

Kim Gordon, Fethard-on-Sea, New Ross, had been convicted of driving without insurance at Clonmines, Wellingtoo­nbridge, on September 28, 2018, when she appeared before the District Court, and disqualifi­ed from driving for two years.

Garda Niall Brophy gave evidence to Wexford Circuit Criminal Court that he had stopped the defendant while driving on the occasion at Clonmines, Wellington­bridge. At the time she was driving without insurance.

Kim Gordon (24) in evidence said that on the night she and her partner had bought a car for which they had hoped to get insurance the following day. Her partner was in the car with her but he was addicted to drugs and was not driving at the time.

She also said that she was in a violent relationsh­ip, but prior to this she had never driven without insurance, adding that she has no car presently. She also said that she had taken her driving test on two occasions and will take the test again.

Mr Jordan Fletcher, Defence Counsel, said she is asking the court for a chance. He would ask the court to consider giving her a chance on this occasion.

Judge John O’Connor said he would remove the two-year disqualifi­cation but would order that the appellant keep the peace and be of good behaviour for 12 months in her own bond of €100, and also come under the Probation and Welfare services as required.
