Doctor fined for Kiltealy accident
A MOTORIST received a fine but no driving disqualification when his case went before a recent sitting of Gorey District Court.
Tahir Hussain, 8 Hanstead Grove, Lucan, was charged in relation to alleged road traffic offences committed at Wheelagower, Kiltealy, on November 2, 2017.
Judge Brian O’Shea heard the charges arose out of a road traffic accident that occurred at the stated location.
The court heard the defendant failed to stop at a stop sign and as a result another motorist ‘ t-boned’ him.
Solicitor, Lana Doherty, told the court the junction where the accident occurred is a dangerous one.
With regard to her client she described him as being a 53-year-old GP from Dublin who works for Caredoc.
‘He never made a statement he would have disputed that he didn’t stop and travelled across a blind junction,’ said Ms Doherty.
The judge said he had to look ‘at the reality of the situation’ and noted a guilty plea was entered. He said though the consequences were serious it was ‘a momentary lapse of concentration’.
However, he added that loss of mitigation arose because the defendant was before him ‘without an entirely clean record’.
‘He has shown great disregard to road legislation,’ said Judge O’Shea.
‘However, he has entered a plea on the first opportunity available to him to Section 52, careless driving but that followed a conversation with Ms Doherty,’ he added.
The judge said that because of that, and because of the guilty plea, he was imposing a fine of €500 but not a driving disqualification.
