Man fined €250 over assault

A CARNEW man who assaulted a man outside his home was fined €250 at Arklow District Court last Wednesday.

Gavin Doyle of 25 Emmet Place, Carnew, had denied assaulting Kyle Askins at the same address on July 13, 2013.

In evidence, Mr Askins told the court that he was walking home from his friend’s house at 6 a.m. when he saw the accused jump out from over the wall.

He was hit on the back of the head but did not see who did this and when he regained consciousn­ess, he said that Doyle was sitting on top of him.

He said that the two of them fought for a while before he got Doyle off him and that his head was ‘ busted open’.

Mr Askins said that he walked to his friend’s house and called the ambulance. He went to hospital and received seven stitches.

Una Doyle, mother of the accused and outside of whose house the assault occurred, gave evidence that she was woken up close to 6 a.m. when her son came into her room and told her something was ‘going on’ outside.

She said that Kyle Askins was throwing stones at the window and that he left a bottle of perfume and a vest in her garden.

She said that her son Gavin ‘ hopped out over the wall and grabbed Kyle’.

Mrs Doyle added that Mr Askins said something like ‘ let’s call it quits, Gavin’ and then ‘ran off to the top housing estate’.

In evidence, Gavin Doyle said that the injured party threw a bottle of perfume up at the window of his mother’s house and that he and his mother went down to the garden to see what was happening.

He said that he ‘chased Kyle out of the yard and jumped out over the wall after him’ with a stick in his hand.

Doyle said that when he asked Mr Askins what he was doing, he put his head down and charged like a bull and went in over the wall.

The accused said that he told Mr Askins to go away or he would call the guards.

Judge Kennedy said that he was satisfied that an assault had taken place and imposed the fine.
