Settlement­sof €25Kforthre­e injuredchi­ldren

SETTLEMENT­S totalling €25,500 were agreed at Gorey District Court last week for three children who were hurt in a road traffic accident on April 7, 2015.

The court was told that they were passengers in a vehicle which was involved in an overtaking manoeuvre.

All three were suing through their mother Bridget Berry of 50 Madeira Grove, The Moyne, Enniscorth­y. The defendant in the case was Larry Berry.

The Counsel acting in the case told Judge Gerard Haughton that Michael Berry, (5), sustained neck injuries. He complained of neck pain, but when examined, had normal neck movement. His father reported that the child complained of pain.

The doctor couldn’t find the problem, and diagnosed mild muscular pain. The insurance company offered a €7,000 settlement, and this was approved by the judge.

The court also heard that Alice Berry, (9), complained of injuries to the neck and a headache. A medical report showed she had full range of movement, but tenderness. She was diagnosed with soft tissue injury, a very minor injury. An offer of €7,500 was made, and approved.

Bridget Berry, (6), suffered injuries to her shoulder, neck, and legs.

She complained of pain, and during a visit to a doctor a month later, a mild muscular injury was diagnosed, but a full recovery was expected.

A settlement offer of €11,000 was made, and approved by the judge.
