‘I’ll rape and kill you,’ new father told gardaí
A MAN told gardaí that he would rape and kill them and said ‘Who do ye think ye are? The McCarthy Dundons is it?’ in a foul-mouthed tirade only hours after his wife gave birth to their eighth baby.
John Tobin, 43, made the threats while waving the sharp end of a branch at gardaí after a late night car chase in Co. Clare.
He was clocked driving at speeds of 75km through a built up area of Ardnataggle at O’Brien’s Bridge in east Clare.
Ennis Circuit Court heard that Tobin switched off all the lights in his car during the high-speed pursuit at 2am on April 10, 2016.
The court heard Tobin then fled his car and was pursued by two gardaí as he shouted ‘Come on ye c***s! I’ll take every one of ye!’
Prosecuting solicitor Aisling Casey told the court: ‘Mr Tobin said the following: ‘I will rape every one of ye c***s! Ye f***ing p***ks. I’ll kill ye. Come on ye p***ks. Who do you think you are? The McCarthy Dundons is it?’’
In the District Court, Tobin, of Derryleigh, Newport, Co, Tipperary, received a two-year driving ban, a six-month suspended jail term and was fined €300 after pleading guilty to careless driving and threatening gardaí.
He was appealing the two-year ban at the Circuit Court yesterday where his solicitor, Daragh Hassett, told the court: ‘His wife gave birth to their youngest child. He celebrated and had a moderate amount of alcohol consumed.’ Judge Tom O’Donnell removed the two-year ban but raised his fine to €1,000.
