Court told of link to tyres issue

Kildare Circuit Criminal Court was yesterday told that coupled with under-inflated tyres it could have played a role in the horrific crash.

Dayna Kearney, 23, was the driver of a Volkswagen Polo in which the four young women were killed near Athy, Co Kildare, on January 6, 2015.

She has pleaded not guilty to dangerous driving causing the deaths of Charmaine Carroll, 20, and Gemma Nolan, Niamh Doyle and Aisling Middleton, all 19.

Kearney, from Crossneen, Co Carlow, also denies driving a defective vehicle in the incident – the State alleges the tyres on the car were under inflated.

Engineer John Hayes told the jury and Judge Eoin Garvan he examined the scene of the crash and noted the cat’s eyes were above the recommende­d height.

He also noted one of the wheels of the car had suffered a puncture.

Mr Hayes said he noted a scuff mark denoting the point where the car lost control was found at the point where the cat’s eyes were high.

He added: “They were 35mm and particular­ly high to look at.

“In profile the cat’s eye sitting proud of the roadway an inflated tyre crossing them would not cause a problem.

“A sub-inflated tyre will cause a significan­t problem.”

Earlier, vehicle inspector Gda Tony O’halloran spoke about his examinatio­n of the Polo.

He said his probe establishe­d there was a “soft tyre” on the front left side and a flat one on the rear right side.

Gda O’halloran added he believed it caused the car to lose stability and begin a “yaw” that resulted in the collision.

In his closing address, prosecutor Daniel Boland said: “Here we had an inexperien­ced driver on a learner permit with a full load. When the car went [out of control] she wasn’t able to control it.” Defence barrister Roderick O’hanlon said there is no evidence to support the State’s case Kearney did anything to cause the collision. Judge Garvan told the jury they would begin deliberati­ng after his “charge” was

complete today.
