MINISTER PLAN TO TACKLE CHILD SUPPORT DODGERS
Mcentee new rules to take arrears from bank and bill for court costs
DADS who dodge child support could be billed for court proceedings while arrears will be taken from their bank under proposed rules.
Justice Minister Helen Mcentee will today publish a review of the current system containing 26 recommendations with three approaches – consensus, compliance, and deterrence.
Some methods include errant parents having to cover all costs associated with enforcement proceedings, allowing for recovery of arrears from tax refunds, and allowing for regular or lump sum deductions from their bank
REFORM Judges would also have the power to freeze money and assets while arrears are outstanding.
Other methods would include taking deductions from government grants and subsidies while also exploring suspended sentences for non-payment of child maintenance. Deductions from social welfare are also being considered. Ms Mcentee said:
“Non-payment of child maintenance is a common problem and current enforcement options are limited.
“That is why, working with Social Protection Minister Heather Humphreys, I am determined to ensure every child is properly supported.”
“That will involve establishing an interdepartmental group to develop a set of child maintenance guidelines and I will do that without delay.
“I am aware many parents make private maintenance arrangements. However, there will always be circumaccounts. stances in which private arrangements break down or are not possible.
“Courts are tasked with safeguarding the financial welfare of children and it is my firm intention that this review, along with changes being progressed through the Family Justice Strategy, will lead to a family justice system that is effective, efficient and that provides real justice.”
Ms Humphreys added: “Child maintenance is essential in ensuring security and stability for children and protecting families’ welfare.
“My department plays a key role in this regard and very shortly I will be announcing legislative measures to decouple social welfare from our Child maintenance system.”
