Victim suffers ordeal ‘flashbacks’

A SERIAL flasher who performed a sex act in front of a “terrified” hospital patient has been jailed.

Kadima Mbuye, of no fixed abode, had six conviction­s for exposing his genitals and masturbati­ng in public places, Limerick Circuit Criminal Court heard.

At a sentencing hearing on Monday, prosecutin­g senior counsel Lilly Buckley said Mbuye entered the victim’s room at University Hospital Limerick at 4am on March 31 last year, passing through a privacy curtain pulled around the woman’s bed.

Mbuye, also a patient at the time but not known to the victim, stood at the end of her bed, undid his trousers, exposed his genitals and “began masturbati­ng in front of the victim”.

Ms Buckley said the woman at the time was in her bed suffering from postoperat­ive pain and discomfort after having undergone a surgical procedure.

“Pretending to be asleep”, the victim pressed an alarm call button, which she had been holding in her hands inside in the bed. The victim told the court she continues to suffer “flashbacks” of the night, has trouble sleeping, and was diagnosed with “PTSD” post-traumatic-stressdiso­rder “as a result of that night”. Mbuye, 53, a native of the Democratic Republic of the Congo, is seeking “internatio­nal protection”, said his barrister.

Liam Carroll, instructed by solicitor Ian Mcnamara of Darach Mccarthy Solicitors, Limerick, said: “He is subject to a deportatio­n order, which takes effect upon his release from prison.”

Gardai had arrested Mbuye after being called to the hospital on March 31.

He was charged before Limerick District Court on July 2, 2023, and remanded in custody.

Mbuye was given the opportunit­y to have the case dealt with in the district court on a signed plea and face a maximum six months sentence.

However, he contested the matter and was convicted by a jury at Limerick Circuit Court on January 15. Judge Tom O’donnell said the details of the evidence was “deeply disturbing”.

He imposed a sentence of 20 months, backdating the sentence to July 2, 2023.
