MOB boss Daniel Kinahan is facing a St Patrick’s Day nightmare as it’s emerged that a civil case against MTK Global is set to press forward despite his lack of cooperation.
The Star has learned that a US judge has ruled that a lawyer suing Kinahan and MTK can go ahead and provide discovery to the court in his case against the boxing company by March 17 in favour of his motion for there to be a default judgment in the case.
The development could mean that Kinahan and MTK will have to cough up millions if the default judgement then happens.
Boxing promoter Moses Heredia is suing Kinahan and the now dissolved company MTK Global — and is seeking damages of up to $20M (€18.4m) that he previously said he wanted to give a portion to grieving families of Kinahan-Hutch feud victims.
Now we have learned that Mr Heredia’s lawyer Eric Montalvo, a respected former Marine, was officially given the go ahead to bring evidence before the court by March 17 — to support his motion that the trial effectively go ahead without MTK’s input.
Ruling
It is understood he expects to make the same motion in respect of Kinahan too. Speaking exclusively to this paper, Mr Montalvo described the ruling from a Federal court as the most significant outcome in the case to date.
“We are pleased that the court has given this order,” he said. “We look forward to obtaining information which will now allow us to bring this to a conclusion.”
In a document seen by this paper, Judge John W Holcomb formally authorised the plaintiff to conduct discovery in support of its “motion for default judgment” and directed counsel to do so by St Patrick’s Day.
It comes after repeated failures by MTK and Kinahan to respond to the court or to indicate that he or a representative would address the court in any way.
