Driver avoids ban

A man who drove uninsured to ferry his terminally ill mother to hospital for treatment has avoided a driving ban at the District Court last week.

David Kilkenny (40) a DJ from High Street, Longraigue, Foulksmill­s was charged with driving without insurance and speeding at Mount Hannover, New Ross, on October 21 of 2016.

Barrister Emmett Whitmore explained that his client had driven the car to bring his mother to hospital appointmen­ts. He said that she had looked after the insurance payments, but sadly had since passed away. Mr Whitmore asked that Judge Staunton exercise his discretion not to ban his client, as it would have a detrimenta­l effect on his work.

‘It appears that Mr Kilkenny is a hard working man and does require his car,’ he said. ‘ With regard to the facts of the case, I’ll allow him the opportunit­y to avoid a disqualifi­cation.’

Kilkenny was then fined €500 on the no insurance charge, while the speeding charge was taken into considerat­ion.
