A 29-year-old woman who was prosecuted for stealing a €10 pair of shoes and a €3 pair of socks has been given the benefit of the Probation Act after the judge heard she had no previous conviction­s.

Grainne Callan, 121 College Manor, Hoey’s Lane, admitted the theft charge which arose following a detection by store security at the Penneys store in the Marshes on March 23.

The items were recovered and there was no loss to the store.

Solicitor Sean T O’Reilly said his client, who has no previous conviction­s, has three children and was on antibiotic­s at the time of the offence. He said: ‘She was very confused by what happened’.

Judge Brennan dismissed the charge under the Probation Act.

Daly has 18 previous conviction­s, including for illegal casual trading in Dublin from February this year, and criminal damage.

Solicitor Eleanor Kelly said her client is a married man with two children and St Patrick’s Day was the first time he had been out drinking in a while. She said Daly knows his behaviour is ‘totally unacceptab­le’.

Judge Brennan imposed fines totalling €200 and said: ‘If he gets drunk he can pay for it’. They found the controller­s there and a small amount of cannabis on the defendant when he was searched.

Solicitor Barry Callan said his client, who has no previous conviction­s, ‘had been led by his friend in this foolhardy scheme’. He added that Kilijonas, who is from Lithuania, works part time in a local car wash.

Judge Brennan found the facts proven and dismissed the case.
