Manaccused­of assault

A man accused of assaulting a woman and another man during an alleged incident on the Castletown Road has been ordered to have no contact with the alleged victims.

Jason Rogan, (23), 622 Ashling Park, is accused of assault at on March 13. Judge Coughlan was told that it is alleged Gardai responded to a report of an assault and claim they found a man with ‘blood streaming from his nose’.

The alleged victim claimed he had been assaulted by Rogan, whom it is also alleged pushed the woman out of the way to get to the man.

Gardai said they believed the alleged victims are known to the defendant and asked for the case to be adjourned for eight weeks.

Judge Coughlan amended the bail to include a condition that Rogan have no contact with the alleged injured parties and the case is listed again on September 6. David McDonagh, (39), 6 Road 2, Muirhevnam­or, had no insurance at Road 2 on September 4.

Judge Coughlan heard McDonagh has 74 previous conviction­s in total, 17 for no insurance, three of which happened since 2010.

The judge noted this was McDonagh’s fourth no insurance charge in the past seven years.

Barrister Irene Sands said Judge Flann Brennan had ‘dealt with him extensivel­y’ over the years and had finalised what was thought to have been all of McDonagh’s cases at the end of last year, imposing 200 hours community service.

However, this summons had been missed. Ms Sands said her client is a father of two who had gone to pick up his wife from the hospital on this day. She said he would be willing to do additional community service hours.

But Judge Coughlan imposed a ten year ban, a €10 fine and sentenced McDonagh to four months in prison.

He allowed him to appeal in his own cash bond of €300.
