Assaultcausing harm

-

A bench warrant has been issued for the arrest of 34-year-old Oliver Garvey to face sentencing after he was convicted of a charge of assault causing harm.

Dundalk court heard how he kicked on the ground his former girlfriend during an incident in Cedarwood Park, Dundalk, on 9 April, 2014.

The accused, of 262 Cedarwood Park, Cox’s Demesne, Dundalk, did not turn up to meet the case against him.

After hearing evidence from the injured party, Judge John Coughlan noted a medical report and photos of the injuries ‘speak for themselves.’

‘It was a bad beating,’ he added.

The victim said she had been out drinking with Garvey, her boyfriend at the time.

They went back to a friend’s house, then she walked him home.

A verbal fight ensued, she walked away, and he followed her. She continued that Garvey kicked her on the ground.

Her nose was bloodied, and her eyes were bloodshot.

Cross-examined by solicitor, Frank McDonnell, she denied being extremely intoxicated. ‘I can remember as far as he beat me up.’ Patrick Stokes gave evidence that the incident occurred on his property.

He heard screaming outside, then saw a young girl with blood on her face.

She was shaken and stressed, and Mr Stokes believed she was hysterical more through fear, than drink.

Judge Coughlan convicted the defendant, and issued a bench warrant for sentence.
