A Co. Armagh resident accused of driving under the influence of an intoxicant has had the charge dismissed after the court held there was no evidence of his incapabili­ty to drive on the occasion.

Thomas Conway, a 50-year-old lorry driver of 2 Edenappa Road, Jonesborou­gh, had denied the offence which was alleged to have occurred in Dundalk on 19 December, 2017.

He did plead guilty to possession of €30-worth of cannabis and having no insurance on that date.

Garda Barrett gave evidence that at 10.15pm while observer in a patrol vehicle leaving Doolargy Avenue he saw a black BMW 3 Series, the driver of which covered his face.

This car went onto Tom Bellew Avenue and was subsequent­ly stopped.

Garda Barrett said he got a smell of cannabis from the driver whose speech was slurred. He had neither a driving licence or identifica­tion on him.

During a search suspected cannabis was found and Conway admitted having smoked cannabis.
