Molly’s uncle: Martens’ track record should help them get freed on bail

The family and defence team of convicted murderers Molly and Tom Martens are hopeful that the father and daughter could be released on bail within weeks pending their upcoming retrial, they told the Irish Mail on Sunday.

‘Once there’s a file mandate on this [Supreme Court] opinion, which I think takes about three weeks, then they’ll be remanded from custody in the prison system to Davidson County, which will request bond,’ defence attorney David Freedman told the MoS yesterday.

Davidson County, in North Carolina, was the site of the original trial, presided over by Judge David Lee. Father and daughter had both been out on bail before the trial after posting a $200,000 bond, spending that time in their home state of Tennessee, where Molly grew up.

The same scenario could be repeated before the retrial, which is not expected to take place before next year, given North Carolina’s pandemic-affected court backlog.

‘For the last trial, they were out on bail and allowed to go to their home in Tennessee,’ said Molly’s uncle and Tom’s brother-in-law, Mike earnest.

‘Molly and Tom have a wellestabl­ished track record of following everything the court asked them to do, so I would think that there should be no reason that the court would act any differentl­y with them.’

Mr earnest, who works in law enforcemen­t in Virginia, reiterated his belief in the pair’s innocence but did not mention the fact that Molly had broken prison rules five times in three years, according to North Carolina prison officials.
