Suspended jail sentence and six years off the road for driving with no insurance
A KENMARE man narrowly escaped jail this week for driving while disqualified as Judge Waters understood that he had done so on two separate occasions but it emerged that there was only one charge of driving while disqualified at the conclusion of the case.
Robin Kelly of Waterfalls, Lackroe, Kenmare was before the court on a number of driving offences, including driving with no insurance and driving while disqualified at Killowen, Kenmare on July 25, 2018.
He also faced charges relating to a separate date at Releagh, Bonane which also including driving with no insurance on October 25, 2018.
However, there was no charge of driving while disqualified linked to this date leading Judge Waters to not jail him.
“You got lucky,” said Judge David Waters after a second charge of driving with no license was found not be before him.
He had stated that he would jail Mr Kelly because of the charges before him
Defence solicitor, Padraig O’Connell had pleaded for leniency for his client stating that he has a baby due and that a jail sentence would not be appropriate at this time.
Mr Kelly, however, was disqualified for six years from driving for driving without insurance - four years off the road for the Killowen incident and six years for the Bonane incident. He was also given a three month suspended sentence for the Bonane incident. Mr Kelly was further fined €600 for the offences.
