Man (46) accused of assault of 23-year-old

-

DINGLE District Court heard on Friday that a 46-year-old man had followed a 23-year-old into the driveway of the younger man’s house before producing a bat and damaging the man’s car – according to an outline of the garda allegation in the case.

Judge David Waters heard there was a ‘very sensitive background’ to the case of Brendan Ferriter, Ballinaboula, Dingle, who came before the Court charged with a section two assault on the other man and criminal damage – at Monaree, Dingle, on August 12 of last year.

Sgt Miriam Mulhall Nolan told the Court that the Director of Public Prosecutions had agreed for the case to be tried by summary disposal at the District Court.

The Sgt said: “This man went into the driveway of another house after following a person, and when he got in he produced [a bat-like instrument] and struck a car, damaging three windows in the process.”

Sgt Mulhall Nolan said the section two assault related to when Mr Ferriter ‘confronted the driver of the car’, who the Court heard was 23 years of age.

Solicitor for the defence Pádraig O’Connell remarked that there was a ‘very sensitive background’ to the case.

Judge Waters accepted jurisdiction, remanding Mr Ferriter on continuing bail to April 26, when the case returns to Dingle District Court for a plea or a date for hearing.

Mr O’Connell meanwhile applied for the disclosure of garda documents in the case.
