Peter Winters previously of Castle View, Mulrankin, Bridgetown but ‘technicall­y homeless’ as his solicitor told Judge John Brennan, was fined on conviction for a public order offence.

He was discovered by Garda Whelan in the Crossfarno­gue estate in Kilmore Quay on March 15.

He escaped over a wall but was later arrested in a very drunk and unsteady condition.

It was accepted by the solicitor, Lana Doherty that he had too much to drink on the date in question.

A search by gardaí located the vehicle at Gurteenmin­ogue in Murrintown, where the defendant’s cousin lived.

Solicitor Tim Cummings accepted that his client had made no substantia­l enquiries as to where the Land Rover had come from.

Mr Cummings agreed that Hammond had been reckless in the matter.

The court was also told that the defendant knew the owner of the vehicle.

Judge John Brennan noted that the accused had no record of previous offences of this sort before deciding to allow him the benefit of the Probation Act.
