Definitions
DATA: Information which:
• Is being processed automatically;
• Is recorded with the intention that it should be processed automatically;
• Is recorded as part of a relevant filing system or with the intention that it should form part of a relevant filing system.
PERSONAL DATA:
Data relating to a living individual who can be identified:
• From the data;
• From the data and other information in the possession of the data controller;
• Any expression of opinion about the individual and any indication of the intentions of the data controller or any other person in respect of the individual.
SENSITIVE PERSONAL DATA:
Data consisting of:
• Genetic data or biometric data;
• Filiation or race or ethnic origin;
• Political opinions, philosophical beliefs, religious beliefs;
• Membership in any trade union
• Sex life;
• The commission of or alleged commission of any offence.
DATA SUBJECT:
A named or otherwise identifiable individual who is the subject of personal data.
DATA CONTROLLER:
Any person or public authority who determines the purposes for which, and the manner in which, any personal data are, or are to be, processed.
DATA PROCESSOR:
Person other than an employee of the data controller who processes the data on behalf of the data controller.
PROCESSING DATA:
• Obtaining, recording or storing the information or data, or carrying out any operation or set of operations on the information or data including:
• Organisation, adaptation or alteration of the information/data;
• Retrieving, consulting or using the information/data;
• Disclosing the information/data by transmitting, disseminating or otherwise making it available;
• Aligning, combining, blocking, erasing or destroying the information or data or rendering the data anonymous.
