Prosecution says accused talked himself into trouble

QUEEN’S COUNSEL Caroline Hay has said that evidence in the five-count indictment against murder accused Constable Collis ‘Chucky’ Brown started with him when he went to the Independent Commission of Investigations (INDECOM).

As she presented her closing arguments at the Home Circuit Court in downtown Kingston yesterday, Hay, who is the lead prosecutor in the trial, said that the conspiracy charge is substantiated in Brown’s interview with INDECOM on August 6, 2013.

Quoting from the transcript, Hay said, “Collis Brown: All right, all right, when I came back, I was called by Mr H. in his office and was asked, ... ‘They said that they are forming a team, right?

“Him go round, go round Mr F. until him tell me them forming a team that a go do some drive-by shooting. Like some fellows weh a do the murders them ... . Them a go start some drive-by shooting. Ahm, as we agree, he gave us a vehicle, 8216FJ, a white, a white Probox.”

According to the prosecutor, this statement contained the ingredients of a conspiracy charge such as what was agreed, who agreed, and how they were going to carry out killings.

She also said it was evident from the interview transcripts that Brown spoke to the authorities on his own volition.

After reading selected lines from one of the transcripts, she posed the question to the jury, “Does this sound like a person forced to talk or a person willing to talk?”

Before that, the defence called their sole character witness who said he first met Brown when the cop joined his staff in the Corporate Area.

The witness, who is a former high-ranking police officer, described Brown as a “diligent, mannerly and dependable police officer”.

Brown is on trial for the January 10, 2009, murder of Robert ‘Gutty’ Dawkins, as well as the December 13, 2012, murders of Dwayne Douglas and Andrew Fearon. Both incidents happened in Clarendon.

He is also facing one count of wounding with intent and one count of conspiracy to murder.
