Cease and desist!

Marlon Samuels threatens to sue Curvy Diva

- KIMBERLEY SMALL STAR Writer

Yanique ‘Curvy Diva’ Barrett could be faced with a lawsuit from cricketer Marlon Samuels.

The stylish right-handed batsman said that his name is being dragged through the mud and has asked the entertainer to “cease and desist”.

“Failure to observe this request will result in legal action for an injunction against you to restrain you from further slandering and defaming my name and reputation,” Samuels said in a statement yesterday.

The falling out between the two popular personalities is said to be founded in an unconfirmed and unsuccessful romantic relationship.

When contacted for a comment yesterday, Curvy Diva’s team declined to speak on the matter. However, attorney-at-law Matthew Ricketts said that Samuels’ threat to sue the TV personality-turned-dancehall artiste for defamation of character can fail if truth is on Yanique’s side.

“If it is that Marlon brings a case of defamation against her, as to how successful it is — that is up to Yanique and her team. The words themselves can amount to disparaging him in the eyes of the public. It may or may not affect his career as a cricketer. In any case for defamation, one of the most used defences is that of truth. Her defence would have to be that she’s justified in saying it because it’s true.” Ricketts told THE STAR.

Curvy Diva used her social media platform to allege that she has been the victim of a series of unsavoury actions.

EGO BRUISED

“The worst thing to do to a man is to bruise his ego. He’s gonna act out, throw shade and try his hardest to hurt you back. I know I’m heartless and I try to do better, but intelligence is at the top of the list of characteristics I look for in a man, and clearly that wasn’t your strong point. I get that you’re venting, but stop stressing me. Stay away from my workplace Magnum Kings and Queens, don’t beg them to book you. I’m taking out a restraining order, enough is enough,” she said in the Instagram post.

She did not name Samuels in the comments. However, with speculation rife that Samuels is the target of her tweets, the cricketer yesterday issued a statement in which he warned that he will sue to protect his name.

“It has been brought to my attention that there are allegations in social media circles that a female television personality, who goes by the moniker Yanique Curvy Diva, has made several derogatory posts on social media about me. I am, therefore, informing the public that I refute the allegations made by Miss Yanique Barrett, and I intend to take the necessary steps legally to defend my reputation in due course,” he

said.
